Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Truck GPS (the "App") operated by Fleetzio Inc. ("Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Truck GPS provides commercial truck navigation and route-planning services through a mobile application. The Service includes route calculation, turn-by-turn navigation, Hazmat routing, real-time alerts, and related features. The Service is available on a free (Basic) tier and a paid (Premium) subscription tier.

3. Important Safety Disclaimer

PLEASE READ THIS SECTION CAREFULLY.

Truck GPS is a navigational aid designed to assist commercial truck drivers. It is NOT a substitute for:

• Driver judgment and professional expertise
• Official road signs, signals, and posted restrictions
• Current applicable laws and regulations
• Proper driver training and CDL requirements
• DOT permits required for oversize, overweight, or Hazmat loads

Always obey posted road signs and traffic signals, even if they conflict with in-app directions. Road conditions, temporary restrictions, and construction changes may not be reflected in real-time. The driver is always responsible for safe vehicle operation.

THE COMPANY SHALL NOT BE LIABLE FOR ANY ACCIDENTS, INCIDENTS, FINES, DAMAGES, OR LOSSES ARISING FROM RELIANCE ON THE APP'S ROUTING SUGGESTIONS WITHOUT INDEPENDENT DRIVER VERIFICATION.

4. User Accounts

• You must be at least 18 years old to create an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized account access at security@fleetzio.app

5. Subscription and Payment

The Premium subscription is billed through Apple App Store or Google Play at the rates displayed in the App at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

• Monthly Plan: $9.99/month (USD)
• Yearly Plan: $99.99/year (USD) — equivalent to approximately $8.33/month

Prices may vary by region and are subject to change with notice. All payments are processed by Apple or Google and subject to their refund policies.

6. Acceptable Use

You agree not to:

• Use the App while driving in a manner that compromises your safety or the safety of others
• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Intentionally submit false bridge clearance or road condition reports
• Attempt to access or disrupt our servers or APIs without authorization
• Share your account credentials with others

7. Intellectual Property

All content in the App, including maps, routing algorithms, UI design, and brand assets, is the exclusive property of Fleetzio Inc. or its licensors and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Data Accuracy

We make reasonable efforts to ensure the accuracy of bridge clearance, weight restriction, and Hazmat zone data. However, road conditions change, infrastructure ages, and databases may contain errors. You acknowledge that:

• Map data may not reflect the most current road conditions
• Always verify critical clearance or weight information against posted signs
• The App is a routing aid, not a legal certification of route compliance

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEETZIO INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in Austin, Texas, except that either party may seek injunctive relief in court for intellectual property violations.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via in-app notification or email with at least 30 days' notice. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
